Fernando Fetex Purchase and Sale Terms and Conditions, CNPJ 38.296.3390001-50, headquartered at Rua do Comercio, 1207, Barra do Ouro, Maquiné - RS - Brazil, hereinafter simply called Fernando Fetex, and, on the other hand, customer, qualified at the time of purchasing Fernando Fetex products, hereinafter referred to simply as Customer.
Whereas Fernando Fetex sells products and services over the internet; Considering the Client's interest in purchasing the products offered by Fernando Fetex ("assets, album covers, specialized arts, brushes, animations, logos, posters") in its sales channels; The purpose of this contract is to establish the general conditions of use and purchase of products and services from the client on the Fernando Fetex website.
I. Confidentiality:
It is the responsibility of Fernando Fetex to preserve the confidentiality of all data and information provided by the Client in the purchase process. The security monitoring of the website is advanced and the hosting is compatible with the highest international standards.
II. Customer Service (SAC):
The customer has this service to solve their doubts, solve any requests or complaints regarding their order or any content available on the website. The SAC can be activated by telephone or form on the website.
III. Delivery Policy:
The deadline for delivery of the Products is informed during the purchase procedure, counted in business days. The deliveries of the Products are made from Monday to Friday, from 8 am to 10 pm. Exceptionally, some deliveries of Products may occur on Saturdays, Sundays and holidays.
III.I - The delivery time informed during the product purchase procedure takes into account the demand and the average time to prepare the product. Because it is a creative activity, this time can change.
III.II - Fernando Fetex is committed to keeping the customer updated on the status of his order.
III.III - The customization of products, making kits for social media, back cover and animations, when requested, will only be made after confirmation of payment by the Client.
III.IV - The verification of the adequacy of the dimensions of the product is the responsibility of the Customer, who must ensure that they are in accordance with their need for use.
III.V - It is the customer's responsibility to check that their data, logos and texts have been correctly inserted in the art. As well as the spelling check of this information.
III.VI - The amount informed at the time of purchase only covers a review for adjustments in the art, such as technical adjustments, image correction or orthographic adjustments. Extra revisions will be charged.
III.VII - The download link for the final file will only be available after payment confirmation and customer approval regarding the final art layout.
III.VIII - Purchase policy: When making the payment, the Customer states that it is in accordance with our delivery policy.
IV - Copyright Policy: When purchasing an exclusive art, the Client has a license to use it for personal and commercial purposes. As well as reproduce it in any way that is convenient for you.
IV.I - Fernando Fetex retains the rights to promote and distribute the work and derivative works in such media, but not limited as well; Canvas prints, art prints, clothing and other promotional materials. Where this work is distributed, there will be no titles, marks or measurements to the Client.
IV.II - The Client is free to make changes to the acquired art, however the name of Fernando Fetex can only be credited as the author of the exclusive art if it maintains its original aesthetic characteristics. Or with his authorization.
V. Right of repentance: the Customer will be entitled to exercise the right to repent of the purchase, with the purpose of refund, in which case the following conditions must be observed: The customer can request a refund in case of any technical problem related to the transaction; The refund will only take place in the stage prior to the sending of the final file by Fernando Fetex; When requesting a refund, the customer automatically gives up on the product, being forbidden any form of use by the Customer. The use of a refunded product by the customer violates Fernando Fetex's copyright.
VI - The Customer must request a refund through the Customer Service (SAC).
V.II - It is not possible to request a refund after delivery of the final file once approved by the client.
V.III - For purchases with a credit card, the card administrator will be notified and the refund will occur on the next or subsequent invoice, at once, regardless of the number of installments used in the purchase. The reimbursement period and, still, the collection of the remaining installments after the full refund of the Product value on the Client's credit card carried out by Fernando Fetex, is the responsibility of the card administrator. In the event of collection of future installments by the card administrator, the Client will not be encumbered, since Fernando Fetex, as mentioned above, reverses the full value of the Product in one single payment, with the credit referring to the reversal being granted in full by card administrator on the billing invoice subsequent to the month of cancellation.
V.IV - In purchases paid by bank slip or debit, the refund will be made by bank deposit, within 10 (ten) business days, only in the buyer's current account, which must be individual. The CPF of the current account holder is required.
